Sifriyah Zone At Temple Israel to launch Thursday, September 13th

Temple Israel in Sharon is pleased to announce the scheduled launch of our new Sifriyah ?library? zone for children and their parents.? The Sifriyah zone is an initiative to offer families with young children in our community a meeting and drop in location for programs, workshops and pure enjoyment of our newly refurbished library. ? Six found alive from missing Indonesia asylum boat

Six people were plucked alive from the ocean by a cargo ship and other survivors were spotted Thursday, a day after an asylum-seeker boat disappeared off the Indonesian coast with 150 people aboard.

The recovery of the survivors by the APL Bahrain, after nearly a day in the water, came after Indonesian rescuers abandoned their search.

"We have had confirmation that six survivors have been rescued by a merchant vessel," an Australian Maritime Safety Authority (AMSA) spokeswoman told AFP, adding that the distress call they received said 150 were on board.

In an update, AMSA said more survivors were spotted later in the day.

"HMAS Maitland is attempting to recover the survivors. We do not have confirmed numbers at this stage," the organisation said, adding that crews at the scene had also sighted debris.

Indonesia's National Search and Rescue Agency (Basarnas) received an alert from AMSA early Wednesday that a boat was in distress between Java and Sumatra, 220 nautical miles from the Australian territory of Christmas Island.

Basarnas sent two police rescue boats and a helicopter but found nothing and returned to base, only for AMSA to task the Bahrain, which responded to an earlier broadcast to shipping, to attend a broader search area.

The captain of the Bahrain said screams and whistles alerted his crew as it scoured the Sunda Strait in darkness.

"We were doing scheduled searching. At the last moment when I was thinking to abort, I heard some noises, and we spotted them in the water," Captain Manuel Nistorescu told the Sydney Morning Herald's website.

"I (sent) a crew to get them and it was not easy... It was dark."

He said the rescued men appeared to be in good condition, adding that they said the pump on their boat failed and the vessel began taking on water.

"They had an engine break and the water was coming, and the pump for pumping out the water was not working and the boat sinks. This is what I understand from them," he said.

Australian Home Affairs Minister Jason Clare said there were serious concerns for those still missing, who include women and children.

"We have grave fears for a lot more," he said. "Don't underestimate how hard it is to find people in the middle of the sea."

AMSA said the survivors would be taken to Merak in Indonesia for medical attention. An Indonesian rescue boat carrying doctors is steaming to the area where the boat sank.

Three merchant vessels were continuing the search alongside Australian naval vessel HMAS Maitland and two Australian P3 Orion aircraft.

Australia is facing a steady influx of asylum-seekers arriving by boat, many of whom use Indonesia as a transit hub, paying people-smugglers for passage on leaky wooden vessels after fleeing their home countries.

Canberra this month said 300 boatpeople had died en route to the country this year, with vessels being intercepted by the Australian navy on almost a daily basis.

Two weeks ago, Canberra announced its intention to transfer asylum-seekers to Nauru and Papua New Guinea in the Pacific as part of a tough new policy to deter them from making the dangerous sea voyage.

But more than 1,000 boatpeople have arrived since the policy was adopted.

"My message to them is, don't get on the boat," said Clare.

"What we've seen today is there is a real risk people will die... that people will end up at the bottom of the sea."

(AP) ? A foundation set up by late chef Julia Child is locked in a legal fight with the manufacturer of Thermador ovens for touting her use of its high-end appliances.

The Julia Child Foundation for Gastronomy and the Culinary Arts claims BSH Home Appliances Corp. is using Child's name and image without permission. The Irvine, Calif.-based manufacturer says it is simply making a factual reference to Child's use of its appliances.

BSH filed a lawsuit in Boston against the foundation last week, asking a federal judge to determine the rights of both sides. The foundation countered by filing two lawsuits this week against BHS, one in state court in Santa Barbara, Calif., where the foundation is based, and the other in federal court in Los Angeles. The lawsuits ask for an injunction to stop BSH from using Child's name and seek unspecified monetary damages.

Child, who died in 2004, had a Thermador oven in her Cambridge kitchen. It's now displayed at the Smithsonian National Museum of American History in Washington. She also used Thermador products on the set of her popular television show, "The French Chef."

In its complaint, BSH said the foundation last month sent the company a letter in which it said it has exclusive ownership and control of Child's name, image, likeness and celebrity identity as well as trademarks and copyrights related to her. BSH said the foundation alleged that BSH's use of Child's name and image constitutes copyright infringement, trademark infringement and "a post-mortem violation of Julia Child's right of publicity."

The foundation demanded that BSH stop using the name, image and "all other indicia of Julia Child's personality," according to the complaint filed by BSH.

BSH acknowledges that it has used images of Child and references to her use of Thermador products on its website and on social media sites, but its attorneys wrote in the complaint that "those uses do not state or imply any endorsement by Ms. Child."

The company said its references to Child "reflect on the long history, significance and influence of Thermador products on American society and culture, and Ms. Child's documented and well-known use of those products."

The foundation, in its lawsuits, said Child, who rose to prominence in the 1960s through her books and TV appearances, had many endorsement opportunities during her lengthy career but chose to forgo them.

"Instead, she focused her career on public education, and allowed her show to be broadcast on PBS, a nonprofit television network, for its entire 10-year run," the state lawsuit said.

The foundation said BHS has featured Child's name and photo prominently in advertising, marketing and promotional materials, including on the homepage of the Thermador website, creating the appearance the Child had been its spokeswoman during her career.

Child was opposed to endorsing products, brands or services, the foundation said in a statement Wednesday.

"She believed it detracted from her credibility as a trusted source to her many fans and colleagues who relied on her for information, guidance and inspiration," the statement said.

(TheBlaze/AP) The New York Times Co. is girding for a legal battle that many larger organizations have avoided.

The Times is leading the defense of a diverse group of companies that use technology they assumed was free: sending text messages with Web links to mobile phones.

The technology was patented by inventor Richard J. Helferich, who filed an outline of how such a system would work with the U.S. Patent and Trademark Office in September 1997. He was granted several patents on the method, giving him the right to sue companies that use it without permission.

Since 2008, his company, Helferich Patent Licensing, has filed 23 suits against companies ranging from Best Buy Co. to the National Basketball Association, claiming they are infringing on his intellectual property.

HPL offers companies the chance to settle by paying a one-time fee of $750,000. Many companies gladly pay, rather than getting bogged down in a court fight that could cost millions. Roughly 100 companies have settled with HPL already, it says, including Apple Inc., The Walt Disney Co. and McDonald?s Corp.

The Times? general counsel, Kenneth Richieri, says he wants to prevent Helferich?s patents from becoming a burden on activities that are commonplace in the digital age.

?In some ways, it?s a tax for being on the Internet,? Richieri said. ?Millions and millions of dollars collectively is going out of the pockets of people who earned it to people who, in my opinion, didn?t do anything.?

If the Times loses, it?s likely it will have to pay more than the $750,000 that HPL initially sought to continue using the technology. The Times has used it to alert readers by mobile phone of breaking news or severe weather.

The Times is spearheading the defense of a group that also includes CBS Corp., Comcast Corp.?s TV channels Bravo and G4 and J.C. Penney Co., according to court filings. HPL sued The New York Times Co. in July 2010; Bravo, G4 and CBS in October 2011 and J.C. Penney in December 2011.

The technology in dispute has become a key part of the companies? marketing campaigns. CBS texts followers to prompt them to visit its website for exclusive pictures and video to shows such as ?Big Brother.? Bravo sends messages to viewers? mobile phones to get them to participate in live online chats and polls. J.C. Penney lets shoppers with mobile phones know about sweepstakes and giveaways.

Although the lawsuits were filed separately, the defendants are saving money by sharing strategies and resources instead of fighting the lawsuits on their own. The lawsuit against the Times is scheduled to go through at least the middle of next year.

Steven Lisa, a registered patent attorney who represents HPL, would not comment on the specifics of any settlements.

The U.S. patent system is designed to protect inventors and allow them to profit from their ideas. Where would General Electric be without legal protection for Thomas Edison?s light bulb? The patent office views its role as vital to the growth of the U.S. economy, and last year, it issued around 245,000 patents.

HPL?s cases, however, fit into a controversial category. Opponents point out that HPL doesn?t make products or provide services. They say it simply uses patents to seek licensing fees from others who actually do business. Critics label such companies ?patent trolls?.

?You really have to wonder what contribution they are making to our economy or our society, or if it?s just a drain,? said Jason Schultz, director of the Samuelson Law, Technology & Public Policy Clinic at the University of California, Berkeley.

Patent trolling is legal. The patent office doesn?t require inventors to put their ideas into action.

In 2011, entities like HPL sued 5,073 companies in the U.S. for infringing on patents that they either got on their own or acquired. That was more than double the number in 2009, according to PatentFreedom, a research organization that offers consulting advice for defendants in patent lawsuits.

PatentFreedom estimates the typical cost of a patent defense is $1 million to $5 million. Taking the low estimate, multiplied by the number of defendants, it sees such suits as a drag on the economy of more than $5 billion a year.

?Law firms are doing very well at this. Operating companies are not,? says Daniel McCurdy, the founder of PatentFreedom.

The Times is fighting the case on two fronts: at the U.S. Patent and Trademark Office and in the courts. Beginning late last year, it filed a number of complaints with the patent office on grounds that the government issued the patents incorrectly. The Times? legal team notes, for instance, that Intel Corp. received a similar patent in February 1996, some 18 months before Helferich got his. A few of the complaints have initially been found in the Times? favor, according to the newspaper company?s outside counsel, Brian Buroker, although HPL is appealing. The process could take 18 months to complete.

The Times is also fighting the case in the U.S. District Court in Chicago, where it argues HPL already receives licensing fees from cellphone manufacturers for the same technology and therefore shouldn?t be allowed to double dip and charge content providers.

Some see the case as highlighting the need for patent reform.

Berkeley?s Schultz says it should be easier for defendants to force the patent office to re-examine its past decisions on issuing patents, and easier for patents to be struck down in court. That way, patent holders would be less able to make a business out of extracting settlements by using the threat of costly litigation.

Some changes are coming. Last September, President Barack Obama signed into law the first major change in patent law in six decades. It is aimed at streamlining the patent process, reducing costly legal battles and giving the patent office more money to process applications in a timely fashion.

Certain parts of the law won?t take effect until March, but a provision that took effect right away has made it more difficult for patent holders to name dozens of defendants in a single suit. That has led to a decreased number of companies sued. PatentFreedom estimates the number of defendants this year will fall to around 3,500.

As an enterprise focussed technology consultant, you generally wait until you have something close to the ?perfect? product with all the bells and whistles a v1.0 ?is expected to have prior to launching the product into a production environment. Truth be told there are some big differences between an enterprise product and the soft launch of a new Internet based product or service, not the least of which includes concerns around security and performance. The truth is, given that you are launching a product into an environment that has a concrete business need for it, there could be some significant negative business impact if the product fails to behave as expected. In the Internet startup space however, other than some market validation and A/B testing that you might have done, you don?t even know if anyone cares about your product. Chances are on day 1 other than your core team and a few early supporters nobody does. Hence its critical for you to get the product out as quickly as possible, and begin getting some real world engagement and quality feedback. This step is countless times more important at this stage of the venture, than building out the new cute widget that you think your product needs.

On July 16th we launched our product and invited a handful of users to begin using the product. Boy, are we glad that we made that decision. Waiting a few more weeks, and building out a few more features might have helped a bit, but would probably have hurt us more. Lets provide some concrete insight into what I mean by this. Our product, Neulantis, currently is being built with the objective of enabling designers, developers and domain experts to incubate their ideas on the platform, and to help them find a team to kick start their vision. All version 1.0 of the product had to enable this was:

  • the ability to create a profile
  • the ability to initiate a project and add required skills
  • the ability to provide project updates
  • the ability to follow or join a project

Some of the key features that were not included in version 1.0 included:

  • the ability to communicate with other users either through a messaging system or through a discussion forum on the platform
  • the ability for updates to be broadcast to project followers and team members

Now, while some might consider this to be a broken product, particularly with the inability to initiate conversations with others on the platform or go back and forth with project initiators, we believe that the core functionality required to convey the idea to people and begin true market validation was already there. Up to this point we had no concrete way of knowing if people even cared to post their ideas on the platform, however following the release when people began posting their project ideas we knew that this could work. This was the ultimate purpose of R1.0, to test our most basic assumptions ? that people would be willing to post their project ideas, and other were willing to join or follow these projects.

On the same token, some will argue that we could theoretically have tested this assumption with surveys, basic mockups and splash pages, but the truth is at that point people are still not using the product, and from our perspective the sweet spot to truly test your most basic product assumptions lies somewhere between a splash page, and a fully functioning robust product. You need people using the product in some concrete way before your assumptions can be really validated. Further without an actual product, it very difficult for people to provide any quality feedback, and at this stage of the venture engaging your early user base, and providing them a sense of ownership is as critical as having them take the first step of registering on the platform. Since we launched our product, almost our entire development process has been guided by early user feedback, and hypothesis validation vs. master planning, and the product is better off because of this.

(AP) ? With Isaac bearing down on New Orleans, the city finds itself at a delicate moment in its rebuilding since Hurricane Katrina struck seven years ago.

Private and government investment is fueling the push to overhaul some of the city's troubled but culturally rich neighborhoods near the French Quarter, where poor families are being replaced as wealthier ones move in. While the city's in a boom and even gentrifying, some question whether it will wither the roots that grew the city's distinctive identity.

"New Orleans is becoming a boutique city like San Francisco," said Gary Clark, a politics professor at Dillard University. "You may see black middle class moving in, but with gentrification there's overwhelmingly white individuals of means who become the new urban pioneers."

The number of whites, although smaller than before Katrina, has grown as an overall percentage from 28 percent to 33 percent of the city's population. The city has its first white mayor since the 1970s, while the City Council now has a majority of white members.

On the flip side, blacks say there's danger that their community will be diminished in a city that owes deep cultural and economic debts to its Afro-Caribbean roots. Since the storm the African-American community has shrunk by about 118,500 people, dropping from about 68 percent of the population to about 60 percent.

"(Blacks) don't see themselves as being a part of the recovery economy and getting real opportunity," said Nolan V. Rollins, the Urban League of Greater New Orleans president.

It's not clear what effect Isaac could have on the city. On Tuesday afternoon, the storm had become a Category 1 hurricane with winds of 75 mph.

Isaac was expected to come ashore near New Orleans by early Wednesday, the seventh anniversary of Katrina's devastating strike on the city.

This winter the U.S. Department of Housing and Urban Development plans to demolish the last of the New Deal-era public housing still standing in New Orleans ? the 850-unit Iberville complex. It was erected over the slums of what was for a time the nation's only legal red-light district, Storyville.

The demolition is part of a $31 million HUD "choice neighborhoods" project, a concept pushed by the Obama administration across the nation. HUD hopes that by starting the process of gentrification, private investment will follow and the communities will become desirable places for all races and classes to live in.

Linda Couch, a public housing expert at the National Low-Income Housing Coalition, said the new approach "has the elements of success."

Meanwhile, another $4 billion in private and government investment has been pouring into the historic neighborhoods of Iberville and Treme, the hearth of the city's African-American culture.

The 1.4 square miles where much of the redevelopment is occurring has long been known for gumbo, jazz, voodoo and civil rights pioneers. Immigrants from around the world lived side by side with blacks in Treme and Iberville, where Louis Armstrong once walked the streets and delivered coal as a boy.

But the entire area fell on hard times after the 1960s, as whites moved to the suburbs and bad urban planning took its toll. By the time Katrina hit, it was struggling and looked like an urban desert of blight, drugs and abandonment in many areas.

The plan for redeveloping the area could include the removal of a noisy concrete interstate expressway that runs through Treme with the hope of restoring what was one of the city's main streets for black commerce. Work is already underway to turn an unused rail corridor into a miles-long walking and bike path called the Lafitte Greenway, turning old schools into new charters and opening "fresh-food" supermarkets.

Taking down the Iberville housing complex is crucial, planners say, to connect Treme with the downtown's theater and business district on Canal Street.

"I think we can retain the soul of New Orleans and in fact enhance it by going through this process," said David Gilmore, a HUD housing expert leading the planning effort.

Many residents see a chance to save neighborhoods that have fallen prey to drugs, poverty and blight.

"We're happy if someone moves down the street into a blighted property," said Jennifer Jones, the self-styled "queen of the second-line" and member of a Treme family of musicians. "No one's angry about whites moving in. When we grew up, there was a lot of mixing going on," Jones said.

But others are apprehensive.

"Maybe they've got their reason," said Lionel Glenn, a 69-year-old retired laborer who ended up at Iberville after another project he was in was torn down after Katrina. "I'd like to stay, but I've got to move."

A recent article in a black community newspaper, The New Orleans Tribune, blared: "They're here" in referring to whites looking to buy up inner-city property. The headline read: "Gentrification: The New Segregation."

Unlike the other redevelopments after Katrina, HUD promises to find housing for all the 440 families at Iberville within about 1 mile of the project.

After Katrina, most of the city's projects were torn down quickly and families were dispersed across the nation. Advocates charged that policy forced poor families out of New Orleans. Public housing units were cut in half at those complexes.

"What has happened is exactly what many people predicted would happen," said Lance Hill, who runs the Southern Institute for Education and Research, a race relations center at Tulane University. "Blacks have ended up in apartments ringing the city."

Mayor Mitch Landrieu says there is no reason to fear the redevelopment.

"We're building it back better than it ever was before and the way it always should have been."

In Treme, there are about 200 more white households than before Katrina, Census data shows. Newcomers and old-timers have clashed, even at times over the noise from the impromptu second-lines, the cherished musical parades, which routinely break out. Also, longtime residents worry about the closing of neighborhood bars.

"They are looking for a French Quarter look-a-alike but with a bedroom community feel," said Al Jackson, a Treme resident and historian.

One newcomer is David Williams, a 49-year-old school administrator. He bought an historic home that for now he rents out. The last batch he rented to was a group of young people with Americorps.

Once their son leaves home, he and his wife have talked about moving into the city and living in the house they've bought.

"In 10 years (this neighborhood) is going to look like Treme does a block away from the French Quarter," he said.

Arizona voters pick GOP nominee for US Senate

PHOENIX (AP) ? An unexpectedly feisty campaign marked by accusations of hypocrisy, broken promises and flip-flopping positions on the emotional issue of immigration draws to a close Tuesday when Arizona voters narrow the field of candidates to replace retiring Republican U.S. Sen. Jon Kyl.

Six-term Rep. Jeff Flake is the favorite to win Arizona's Republican nomination in one of this election year's final round of primaries, which will also see the ousting of one of two freshmen incumbent GOP House members pitted against each other by redistricting. Five other House incumbents, including Gabrielle Giffords' hand-picked successor, face challengers.

Voters in Alaska and Oklahoma also will decide House races.

In Arizona, Democrats are hoping the surprisingly aggressive ? and costly ? challenge to Flake by wealthy businessman Wil Cardon will give them their best shot in years at taking one of the state's two Senate seats. The Democratic challenge by moderate Richard Carmona, a former surgeon general under President George W. Bush, comes as the GOP is fighting to pick up four more seats to wrest control of the chamber in advance of votes on key policy issues such as the possible repeal of President Barack Obama's health care law and changes to the tax code.

Arizona hasn't elected a Democrat to the Senate since Dennis DeConcini won his third term in 1988, but Democrats are hoping the primary attacks on Flake have weakened his standing and his bank account.

"Jeff Flake has been a little wounded by the primary," said Jim Pederson, a former Democratic Party chairman who lost an expensive race six years ago to Kyl. "I think a lot of the issues that Wil brought up will kind of resonate with people. I think (the general election) is going to be very close."

Cardon spent $6 million of his own money trying to paint Flake as a Washington insider who reneged on past promises to limit his terms in office. Opponents pointed to Flake's little-known past as a Washington lobbyist for a uranium mine that was minority-owned by Iran. He also criticized Flake's dramatic change on immigration, from a supporter of comprehensive reform to backing policies that would first secure the border.

For his part, Cardon was accused of painting himself as tough on immigration, while a company he partly owned was fined for faulty paperwork in hiring workers with questionable legal status.

Cardon is widely seen as having begun to cede the race in the past month, turning positive in his campaign messages and ending months of expensive television ad buys.

In Alaska, five Democrats are vying for the chance to challenge Republican U.S. Rep. Don Young, who has held his seat for 40 years. Young has two challengers, but is expected to easily win his primary.

In Oklahoma, two Republicans and two Democrats are vying in runoff elections for their parties' nominations for the seat being vacated by Democratic Rep. Dan Boren.

One or both major parties have primary races in all nine of Arizona's U.S. House districts, including the two-incumbent rivalry between freshman Republican Reps. Ben Quayle and David Schweikert in the 6th Congressional District centered on Scottsdale. Quayle moved into the district ? the bulk of which he previously represented ? after redistricting put him in a neighboring district considered more competitive with Democrats.

Book Note: Bringing Up Bebe by Pamela Druckerman ? Reading ...

I?ve been waiting for this book to come available for several months. The waiting list at our library was in the twenties. When I first heard of Bringing Up B?b? by Pamela Druckerman I had just finished reading The Conflict: How Modern Motherhood Undermines the Status of Women by Elisabeth Badinter. Badinter, a French woman and mother, wrote her account as a criticism of naturalist philosophies of childrearing that often consume a mother?s time and create unparalleled strains of guilt. In most cases she applauded the slow influence of these ideas in France, but wondered how long the French mothers could resist the pressure. When Druckerman?s book came to my attention I was intrigued to hear an American mother?s perspective on French child-rearing. I hoped it would be an interesting balance though their topics and approaches were not directly related.

Turns out, there are some distinct differences in parenting approaches. Druckerman introduces her inquiry by relating a story of taking her toddler out-to-eat. At the time? I was reading this Hubby and I had just experienced exactly what she described:

Bean is briefly interested in food: a piece of bread, or anything fried. But within a few minutes she start spilling salt shakers and tearing apart sugar packets. Then she demands to be sprung from her high chair so she can dash around the restaurant and bolt dangerously toward the docks?.Our strategy is to finish the meal quickly. We order while we?re being seated, then we beg the server to rush out some bread and bring us all our food, appetizers and main course, simultaneously. While my husband has a few bites of fish, I make sure that Bean doesn?t get kicked by a waiter or lost at sea. Then we switch. We leave enormous, apologetic tips to compensate for the arc of torn napkins and calamari around our table.? (pp. 1-2)

As this scene unfolds she manages to glance around and makes a quick observation: the french children in the restaurant aren?t throwing their food or pitching fits. They seem to be distracting themselves quietly and waiting. And the parents are eating courses in stages. Druckerman was flabbergasted (as I would have been) and started sleuthing around to discover their secrets.

Druckerman lives in the suburbs of Paris with her English husband and, by the end of the book, three children. She started her investigation of French parenting techniques with her first and continued to learn after her twin boys were born. At times I found myself empathizing and agreeing with her commentary on American ideals and approaches; other times I found myself squarely in the French camp. I totally understand her ambivalence about letting her five-year-old take a 10-day field trip without her, but I don?t have a problem giving my daughter a firm ?no? when need be. I can relate to giving praise and ?good jobs? to Little E when she successfully accomplishes a new task, remembers her manners, or just generally behaves, but I agree with firmly establishing a bed time.

There?s always a bit of blur when examining parenting approaches ? and particulary with a task as enormous as representing a national consensus on the subject ? every one does it differently and the individuality of the child factors in as well. Still, her anecdotes, interviews, and analysis of French attitudes toward feeding, discipline, day care, losing weight, sleeping through the night, and post-baby marital bliss are compelling and challenging. At each point I considered, ?Huh, what do I think about that??

There are a few ideas and approaches that philosophically I can agree with and may even try with Little E or any future children (I will definitely be attempting to get Hypothetical Child #2 to ?do his/her nights? by 3 months ? after suriving a child who, at 17-months is still not consistently sleeping through the night, I will make a strong effort to avoid a repeat). There are a few that don?t mesh with my parenting attitude ? I understand we don?t need to smother our children with attention, but I couldn?t help thinking (all the way through the book) ?When do they play with their children??

All in all a good read. It started to read more like a research paper (still interesting though) in the middle, but the stories were integrated well in the beginning and end. Druckerman does an excellent job of providing her own experience as well as including examples from other intercultural couples and?wide range of French mothers.?It provided me with a different look at parenting and informed my understanding of Badinter?s concerns specifically. A good read for moms, intercultural parents, or book clubs ? there?s plenty in here to enjoy, consider, and debate.
